Terms of Service

1. Acceptance of Terms
By accessing or using the Spotify MCP Server software ("the Software") or the playmcp.dev website ("the Website"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Software or Website.
2. Description of the Software
The Software is an open-source developer tool, distributed under the MIT License, that enables Claude (an AI assistant by Anthropic) to interact with the Spotify Web API on your behalf. The Software runs locally on your machine and does not operate as a hosted service.
3. Eligibility
To use the Software, you must:
- Be at least 13 years of age (or the minimum age required in your jurisdiction)
- Have a valid Spotify account with Premium subscription (required for Developer Mode)
- Comply with Spotify's Developer Terms of Service
- Comply with Anthropic's Terms of Service for Claude
4. License
The Software is licensed under the MIT License. You are free to use, modify, and distribute the Software in accordance with that license. The full license text is available in the project's LICENSE file.
5. Your Responsibilities
You are solely responsible for:
- Securing your Spotify API credentials (Client ID) and token encryption key
- Any playlists created, modified, or deleted on your Spotify account through the Software
- Complying with Spotify's terms regarding API usage, including Dev Mode limitations
- Ensuring that your use of the Software does not violate any applicable laws or regulations
6. Spotify Platform Terms (Required Clauses)
The following clauses are required by Spotify's Developer Terms of Service (Version 10, effective May 15, 2025) and apply to your use of this Software:
- No Warranties by Spotify: WisetechySolutions makes no warranties or representations on behalf of Spotify and expressly disclaims all implied warranties with respect to the Spotify Platform, Spotify Service, and Spotify Content, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- No Modification: You may not modify or create derivative works based on the Spotify Platform, Spotify Service, or Spotify Content.
- No Reverse Engineering: You may not decompile, reverse-engineer, disassemble, or otherwise reduce the Spotify Platform, Spotify Service, or Spotify Content to source code or any human-perceivable form.
- Developer Liability: WisetechySolutions is solely responsible for this Software and disclaims any liability on the part of Spotify or other third parties.
- Third-Party Beneficiary: Spotify AB is a third-party beneficiary of these Terms of Service and the Privacy Policy, and is entitled to directly enforce any rights that relate to its interests.
7. Intellectual Property
"Spotify" is a registered trademark of Spotify AB. "Claude" is a trademark of Anthropic PBC. "Cloudflare" is a registered trademark of Cloudflare, Inc. The Spotify MCP Server is not affiliated with, endorsed by, or associated with Spotify AB or Anthropic PBC. All third-party trademarks are the property of their respective owners.
8. No Warranty
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. The Software may break if Spotify changes their API, if Anthropic changes the MCP protocol, or for any other reason. We make no guarantees of availability, accuracy, or fitness for any purpose.
9. Limitation of Liability
IN NO EVENT SHALL THE AUTHORS, COPYRIGHT HOLDERS, OR CONTRIBUTORS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
This includes, without limitation:
- Loss of data, playlists, or Spotify account access
- Unauthorized access resulting from misconfigured credentials
- Any actions taken by Spotify, Anthropic, or other third parties
- Service interruptions caused by API changes or rate limiting
10. Indemnification
You agree to indemnify and hold harmless WisetechySolutions and its contributors from any claims, damages, or expenses arising from your use of the Software, your violation of these terms, or your violation of any third-party rights.
11. Third-Party Services
The Software integrates with third-party services that have their own terms:
- Spotify — Developer Terms and User Agreement
- Anthropic — Terms of Service
Your use of those services is governed by their respective terms. We are not responsible for the actions, content, or policies of any third-party service.
12. Intellectual Property & Trademark Notices
"Spotify" is a registered trademark of Spotify AB. "Claude" is a trademark of Anthropic, PBC. "Cloudflare" is a registered trademark of Cloudflare, Inc. All other trademarks are the property of their respective owners.
The use of third-party trademarks in this project's documentation and website constitutes nominative fair use for the purpose of describing interoperability. This project is not affiliated with, endorsed by, or sponsored by Spotify AB, Anthropic PBC, or Cloudflare Inc.
The Spotify MCP Server software is copyright WisetechySolutions and is distributed under the MIT License. See the NOTICE file for full third-party attributions.
13. Spotify-Specific Terms
By using this Software to interact with the Spotify Web API, you agree to comply with Spotify's Developer Terms of Service and Developer Policy. In particular:
- You must have a valid Spotify account and comply with Spotify's User Agreement
- You may not use this Software to circumvent Spotify's technical restrictions or rate limits
- You may not use this Software to download, cache, or redistribute Spotify content
- You may not use this Software for audio streaming, playback, or DJ/mixing functionality
- You are responsible for any playlists created, modified, or deleted on your Spotify account
- Spotify may revoke API access at any time and for any reason
14. AI & Machine Learning Disclaimer
This Software does NOT use Spotify data to train, fine-tune, or otherwise improve any artificial intelligence or machine learning model. Music recommendations are generated entirely by Claude's pre-existing training data. Spotify search results are used solely for the purpose of finding and adding tracks to playlists — they are held in memory for the duration of each request and then discarded.
The Software acts as a bridge between Claude's recommendations and Spotify's catalog. No Spotify Content (as defined in Spotify's Developer Terms) is "ingested into" or used to train any AI model.
15. AI Output Accuracy
Music recommendations generated by Claude are based on AI-generated knowledge and may contain inaccuracies. Factual assertions in AI-generated outputs (including track attributions, artist information, and thematic descriptions) should not be relied upon without independently verifying their accuracy. Playlists created by the Software reflect Claude's recommendations and may not match your expectations or preferences. WisetechySolutions is not responsible for the accuracy, completeness, or quality of AI-generated content.
16. Data Breach Notification
In the event of unauthorized access to stored Spotify OAuth tokens or other user data, WisetechySolutions will:
- Notify Spotify at security@spotify.com within twenty-four (24) hours of discovery, as required by Spotify's Developer Terms
- Notify affected users without undue delay
- Take immediate steps to contain and remediate the breach
17. Modifications
We reserve the right to modify these Terms at any time. Changes will be reflected by updating the "Last updated" date at the top of this page. Continued use of the Software or Website after changes constitutes acceptance of the revised terms.
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
